Terms of Service
1. General
(1) These General Terms and Conditions apply between ScanKit.io c/o Martin Stämmler, Am Bartelskamp 16, D-38553 Wasbüttel, hereinafter referred to as "ScanKit.io" or "we/us," and you when using the ScanKit API and SDK. These terms govern all users of our B2B document scanning services, primarily businesses, freelancers, and organizations integrating our services into their workflows.
(2) ScanKit.io provides tools for image processing, including API access for document scanning and an SDK for integrating scanning functionalities into cross-platform applications. These services are intended for business use only.
(3) ScanKit.io reserves the right to decline the conclusion of a contract if there are important reasons, such as conflicts of interest, statutory reasons, or misuse concerns.
2. Registration and API/SDK Access
(1) To use ScanKit.io’s services, users must register using a valid email address and create an account. Acceptance of the privacy policy is a prerequisite for account creation and service access.
(2) Users are responsible for maintaining the confidentiality of their account credentials. Sharing accounts with third parties is prohibited. In case of suspected account misuse, users must notify ScanKit.io immediately. ScanKit.io reserves the right to block accounts in such cases.
(3) Users must ensure that their integration and use of the API and SDK comply with applicable laws and regulations.
3. Pricing, Subscription Duration, and Termination
(1) ScanKit.io offers subscription plans that are billed monthly or annually. Subscriptions automatically renew unless canceled before the end of the term.
(2) The notice period for termination is 1 day before the end of the subscription term. Cancellations can be processed via the user dashboard or submitted in writing. The effective date of termination is based on receipt by ScanKit.io.
(3) Payment options include credit card or other methods specified during subscription signup.
4. Provision of Services
(1) ScanKit.io’s services, including its API and SDK, are continuously improved and may be updated or modified. Significant changes to features will be communicated with reasonable notice.
(2) While ScanKit.io aims to provide 98% annual uptime for its services, temporary outages may occur due to maintenance or circumstances beyond our control.
(3) Technical support is available via email at info@scankit.io.
5. Customer Obligations
(1) Users are prohibited from using ScanKit.io’s services for purposes outside of their intended business applications without prior written consent.
- Attempting to introduce malicious code, including viruses or trojans.
- Engaging in unauthorized manipulation or misuse of the API/SDK.
- Overloading the infrastructure with excessive or unreasonable requests.
- Sublicensing or redistributing the API/SDK without permission.
(2) Users must ensure compliance with all applicable laws and regulations when using the API or SDK.
6. Liability
(1) ScanKit.io is only liable for damages caused by intent or gross negligence. In cases of slight negligence, liability is limited to breaches of essential contractual obligations.
(2) ScanKit.io is not liable for issues resulting from user misuse, unavailability due to third-party failures, or improper implementation of the API/SDK by the user.
(3) Users indemnify ScanKit.io against claims arising from illegal or unauthorized use of the API/SDK.
7. Changes to Terms of Service
(1) ScanKit.io reserves the right to amend these Terms of Service. Changes will be communicated via email or the user dashboard at least two weeks in advance.
(2) Continued use of ScanKit.io’s services after changes take effect constitutes acceptance of the updated terms.
8. Final Provisions
(1) German law applies to all contractual agreements with ScanKit.io, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).
(2) Should any provision of these terms be deemed invalid, the remaining provisions remain enforceable.
(3) The place of jurisdiction for disputes is the registered location of ScanKit.io.
